These Terms of Use ("Terms") are a binding agreement between you and AK JAMZ ("AK JAMZ", "we", "us", "our") governing your use of the AK JAMZ iOS app (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules, and subject to these Terms.
The App is also governed by Apple's standard Licensed Application End User License Agreement (the "Standard EULA"), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These Terms supplement the Standard EULA. To the extent these Terms conflict with the Standard EULA, the Standard EULA controls with respect to your license to use the App, except where these Terms are more protective of you or of third parties.
These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
After you complete the age-eligibility screen, the App may create an anonymous guest account so you can browse. You can upgrade with Sign in with Apple or a verified email/password account. You are responsible for activity under your account.
You must be at least 13 years old to use AK JAMZ. If you are below the age of majority where you live, you may use the App only with permission from a parent or legal guardian who agrees to these Terms. We ask for an age range only to determine whether you are eligible; we do not retain your birthday or selected range. A device-level parental-control exception does not override this minimum age.
AK JAMZ lets users choose a public display, artist, creator, venue, or organization name; broadcast where live music is happening; and post related content ("User Content"). You are solely responsible for the User Content you submit. When you create a profile or post, you agree that:
Zero tolerance for objectionable content. There is no tolerance for objectionable, abusive, or illegal User Content or for abusive users. To use any feature that creates User Content, you accept these guidelines.
Reporting, hiding, and timely review. Users can report objectionable posts or profiles and hide a creator's shows directly in the App. A report is reviewed; it does not automatically prove a violation or remove a profile. We aim to review safety reports within 24 hours and may remove content or suspend or terminate accounts when a report is substantiated.
The App is provided for informational and entertainment purposes only. We are not responsible for events, venues, ticket purchases, or your travel decisions.
The App is free to download and use. There are no in-app purchases or subscriptions at this time. If we offer paid features in the future, the price, billing terms, and renewal terms (if any) will be disclosed in the App at the point of purchase, and any purchases will be processed by Apple under the App Store terms; these Terms will be updated accordingly.
The App, its design, and its content (excluding User Content and third-party listings) are owned by us and protected by law. You retain ownership of the User Content you post, and you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that User Content within the App solely to operate and provide the service.
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the App will be uninterrupted, error-free, or accurate. You use the App at your own risk.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the App, including any reliance on live or upcoming listings, even if advised of the possibility of such damages.
We may suspend or terminate your access for any violation of these Terms. You may stop using the App and delete your account at any time from Profile → Settings → Delete Account.
These Terms are governed by the laws of the State of Alaska, USA, without regard to its conflict-of-laws rules, except that the Standard EULA's governing-law provisions apply where required by Apple. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your place of residence.
We may update these Terms from time to time; the "Effective date" above will change, and continued use of the App after changes take effect means you accept the updated Terms.
